This Privacy Policy only applies to the TLGSA websites and does not apply to, and TLGSA is not responsible for, the privacy policies or practices of websites operated by third parties, even if they are linked to TLGSA websites. If you choose to link to or from another website to or from the TLGSA websites, you should refer to such other website’s privacy policy and practices and note that we do not accept any responsibility or liability for these policies. This policy does not apply to user posts or other third-party content, including, for example posts to our Facebook or other social media site. We do not promise to keep such third-party content private, or to keep private the identity of such third-party contributors. Each TGLSA franchise is independently owned and operated by a franchisee and TLGSA cannot guarantee compliance by all franchisees with this Privacy Policy, although TLGSA will attempt to require franchisees to comply.

I. Information We Collect Automatically

If you visit the TLGSA websites or download information we will automatically collect certain information (“Log Information”). Log Information may include the:

• Name of the domain and host from which you access the Internet;
• Internet protocol (IP) address of the computer you are using;
• Browser software you use and your operating system;
• Date and time you access any of the TLGSA websites;
• Internet address of the Web site from which you linked directly to any of the TLGSA websites;
• Your geographic location;
• The pages of the TLGSA websites that you visit and the time of your visits; and
• Aggregated information that cannot be used to specifically identify you when you use or visit the TLGSA websites.

A “cookie" is a small data file that a Web site can place on your computer for record-keeping, administration, or to customize your experience. Other similar technologies that we use are web beacons and pixels. Cookies and other technologies permit us, franchisees, and selected marketing partners to customize and enhance your experience on our websites and their websites. For example, if you select the “Make This My The Little Gym Homepage" feature on a franchisee Web site, the software will place a cookie on your computer so that the next time you type www.thelittlegym.co.za, you will be directed to your selected franchisee Web site. You may block or remove cookies on your computer by following the instructions on your Web browser.

TLGSA may use the Log Information, cookies, and other technologies to manage and improve the websites; to analyse customer and prospect trends; to track inquiries and purchases; to develop and contact you about products, services and promotions; to enforce our Terms of Use; to protect TLGSA’s legal rights, or those of its customers and franchisees; and for purposes required by law.

We may use cookies and other technologies to deliver information and advertisements to you that better match your interests.

We currently use analytics to give us information about users and their experience on the site, to administer the site, to learn about visitor behaviour and demographics, and to improve our communications and services.

Third parties may collect personally identifiable information about an individual user’s online activities over time and across different Internet services when a user uses the TLGSA websites. At this time, we do not respond to “Do Not Track” signals sent from Web browsers or other mechanisms that provide users the ability to exercise choice regarding the collection of personally identifiable information about a user’s online activities over time and across third party Internet services.

Any Log Information, cookies and other technologies cannot be used to personally identify you, and accordingly, TLGSA may disclose, transfer or share such non-Personal Information for any lawful purpose.

II. Personal Information You Choose to Provide to Us

A. Enrolment Information

If you wish to enrol your child, you may do so either:

• (i) In person at the franchisee The Little Gym location; or
• (ii) By using the https://www.TheLittleGym.co.za page on the TLGSA websites, select a location and then either
  • a. send an email to the franchisee listed which includes personal information such as your name, ages of your children, and your contact information; or
  • b. use the online enrolment feature.

The TLGSA websites may collect and send any such information completed by you, including any identifying number, symbol, e-mail address, physical address, telephone number, location information, online identifier or other particular assignment to you (collectively “Enrolment Information”). Your Enrolment Information may be used for the same purposes as Log Information as described above, and as follows:

• to contact you about:
  • a. enrolling your child;
  • b. upcoming classes, products and services, and promotions; and
  • c. franchise opportunities.
• to improve the usefulness of our websites;
• TLGSA may also share your Enrolment Information with third parties, but only as described in this Privacy Policy or required by law. We may share your Enrolment Information with third parties, for example, when we need to share such Enrolment Information to:
  • a. process your credit card;
  • b. provide a product or service you have requested;
  • c. manage data or host a website;
  • d. to comply with a legal obligation;
  • e. to protect and defend the rights or property of TLGSA; or
  • f. to protect TLGSA against legal liability. or
  • g. administer or enforce our websites’ Terms of Use.
• We may also collect Enrolment Information, and combine it with other information, such as that collected at franchisee locations, from public sources, your Log Information, Member Milestone (customer loyalty rewards) program information, and online purchases in the future. We may use this combined personal information for the purposes described in this Privacy Policy. If you choose not to provide the information that we request, you may not be able to participate or purchase the relevant product or service.

B. Referral Information

If you know a parent who would be interested in learning more about The Little Gym®, you may refer him or her to TLGSA by completing the Refer a Friend form on our websites. TLGSA or the franchisee may use the referral information that you provide to notify the referred parent of your referral and for the other purposes described in this Privacy Policy.

C. Prospective Franchisee Information

If you are interested in learning about franchise opportunities with TLGSA, you may complete the form at https://franchise.thelittlegym.co.za. If you choose to do so, TLGSA will collect your personal information on the form. This form is not an application for consideration as a franchisee. TLGSA may later send you an application form that collects additional information, including financial information such as an estimate of your available liquid capital and approximate net worth (collectively “Prospective Franchisee Information”). TLGSA will not sell, rent, or otherwise disclose the Prospective Franchisee Information you provide without first obtaining your consent. However, if you are an employee of a current TLGSA franchisee, we may communicate the fact of your application to your current franchisee employer.

D. Resume Information

If you’re interested in working at a The Little Gym® location, you may send to any franchisee your resume by email or regular mail to the addresses posted on the careers page located on each franchisee Web site. (Franchisees’ The Little Gym businesses are each independently owned and operated.) If you send information to TLGSA about your interest in employment at a franchisee’s site, we may forward that information to the franchisees located near you, but TLGSA will not rent, sell, or otherwise disclose the information. If TLGSA sends your information to a franchisee, TLGSA will ask the franchisee to not rent, sell, or otherwise disclose the personal information in your resume to any third party, but cannot guarantee that the Franchisee will not do so.

III. General Privacy and Security Policy

A. Business Changes

If we become involved in a merger, acquisition, sale of assets, joint venture, securities offering, business rescue, reorganisation, liquidation, dissolution, or other transaction or if the ownership of all or substantially all of our business otherwise changes, we may share or transfer your information to a third party or parties in connection therewith, consistent with this Privacy Policy and legislation regulating the use of personal information. Any such persons will be bound to maintain any personal information in accordance with this Privacy Policy.

B. Children’s Privacy

Our websites are not for children under the age of 18. We will not knowingly collect personally identifiable information from anyone under the age of 18, and if we discover that we have accidentally done so, we will delete such information. Children under the age of 18 must ask a parent or guardian to provide us with any personal information online, should it be necessary.

C. Security of Online Payment and Other Data

We care about the security of your personal information, and when you submit personal information, such as credit card information, that information is encrypted and protected by Secure Sockets Layer Protocol (SSL) encryption technology and stored on our servers. However, no transmission over the Internet and no electronic data storage method is 100% secure. Therefore, we cannot guarantee the absolute security of the personal information you provide to TLGSA either during its transmission or its storage on TLGSA’s systems. If you believe that the security of your data has been compromised, please notify TLGSA immediately, and if it involves your credit card, immediately notify your credit card company in accordance with their policies.

We reserve the right to modify, alter, or update this Privacy Policy at any time, so we encourage you to review this Privacy Policy frequently in this space. This Privacy Policy is also subject to our Terms of Use posted at the TLGSA websites. This Privacy Policy was last updated on 7th of August 2018.

IV. Request for access to personal information

You shall, having provided adequate proof of your identity, be entitled to:

• submit a request in writing to TLGSA to confirm, free of charge, whether or not TLGSA holds personal information about you; and
• request from TLGSA the record or a description of the personal information about you, including personal information about the identity of all third parties, or categories of third parties, who have, or have had, access to the information at a reasonable fee charged.

V. Acceptance of this Privacy Policy

By providing personal information to a TLGSA or a franchisee, you consent to the collection, use and disclosure of that information in accordance with this Privacy Policy.
